Social Security Disability (SSD)

If you believe you are disabled and unable to continue working, you should be aware that the federal government provides disability benefits that can provide an income during your disability period.  Although you can apply for SSD benefits directly with the Social Security Administration, the rules are complicated, and many valid claims are denied.  Your chances for approval are increased when an experienced attorney helps file the initial claim, and if your claim has been denied, it is essential to have a lawyer on your side in the appeal process. 

How disability is defined

To qualify for SSD, you must prove that you have a physical or mental impairment that prevents you from engaging in substantial gainful activity.  Further requirements state that your impairment is expected to continue for a year or more, or that it will result in death.  The definition extends beyond your ability to continue your previous employment; you must be unable to engage in other available work that would be appropriate based on your age, education, and work experience.

The Social Security Administration (SSA) uses a five-step process to determine disability:

  • Substantial gainful activity:  If you continue to work in the position you held prior to the disability, your claim will be denied.
  • Severe impairment: If you pass the prior test, the SSA next determines your impairment is severe enough to prevent you from performing basic work activities.
  • Listing of impairments:  Next, the SSA compares your condition against their extensive list of impairments.  If your disability is not on that list, or if it is not equivalent to a listed impairment, your claim will be denied.
  • Past relevant work:  The next test is a medical assessment to determine if your impairment keeps you from performing past relevant work.  If you can return to work that you performed previously, your claim will be denied.
  • Other work:  Finally, the SSA determines whether you can perform other work available in the current economy.  If you are physically and mentally capable of performing other available work, and this ability is not limited by your age, education, and past work experience, the claim will be denied.
